The fact that the Saddam Hussein regime had possessed and used WMD in the past was well-established and the burden of proof had since shifted per the terms of the cease-fire agreement which ended the previous conflict. In a similar way, an officer running a maximum security penitentiary would be well-justified in demanding that the inmates regularly prove to him that they are not carrying restricted possessions.

The US knew Saddam had WMDs 'cos they sold them to him in the 1980's, and they also knew that these have a limited shelf-life and were therefore defunct. Their weapons inspectors told the US that Iraq couldn't have any operational WMDs, but Bush, who was just using this as an excuse to attack, ignored the facts and attacked anyway. This was a war-crime and Bush and Blair should hang for it. You may happily accept any phoney excuses for war, but I won't.
