Oct 17, 2009 - I found some of my old training notes. Something I even remember teaching. Anyone know what "muscle memory" is? This officer would have drawn his weapon every day he worked, trained qualified or just to carry if off duty carry is allowed for them. He had to know the feel of his own weapon. It's impossible not to not after drawing or handling it literally hundreds of times in his career. The former officer is going to prison. There is no way around that. It should not be for murder, though.

Oct 19, 2009 - Actually officers, although are well trained with fire-arms, do NOT fire them on a regular basis while on duty, if they do I'm pretty sure they have to go to therapy as per SOP. On an unrelated note, when using a pistol, you always, always have your trigger finger eased off of the the trigger when drawing - until you have your mark clearly targeted, since police don't quick-draw.

You point a gun simply if you deem it necessary to do so, be it due to an increasingly violent or threatening situation, or just whenever you are preparing to defend yourself or someone else against a potentially violent individual. It has nothing to do with "wanting to harm someone," because often, a person with a gun will not actually "want" to use it.

Oct 24, 2009 - Not so much fire them as handle them. Most don't even "gear up" with the weapons in place. You place them in the holster after you've put your belt on. Even then only after you go to whatever safe area they use, charge the weapon (chamber a round,) then holster the weapon. He should have followed this or a similar procedure literally hundreds of times. Basically he knew his weapon as well as he knew his own shoes. It's negligent homicide.

Oct 24, 2009 - Escalation of force comes into play when there is little or no control over a suspect. They had what appears to be a majority of control here thus making such a escalation unnecessary. I maintain that the trigger pull may have been an accident, but drawing that weapon was a willful act. There was no premeditation here so there was not basis for a murder-one charge.

Nov 9, 2009 - This officer is a disgrace. Accident or not, he made an enormous mistake and should serve a long jail term for it. I think he was completely caught up in the moment and just mechanically reacted by shooting the guy. Immediately after the shooting, both cops looked stunned. With that said, this cop is not representative of police everywhere. While there have been many examples of police brutality, it is the everyday cop saving lives on the street that everyone seems to forget in these times.
